These projects are governed by specific regulations that provide a legal framework for their control and management. The objective of these regulations is to enhance environmental conservation and contribute to global greenhouse gas emissions reduction targets.<\/p>\n<p>Under the regulations, the Minister responsible for the Environment in Tanzania holds overall responsibility for <a title=\"GMES &amp; Africa Strengthens Synergy with PolicyMakers to Address Climate Change Effects through EO Technologies\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/gmes-africa-strengthens-synergy-with-policymakers-to-address-climate-change-effects-through-eo-technologies\">climate change<\/a> matters, including carbon trading. The ministry serves as the Designated National Authority or National Focal Point, linking Tanzania with international climate change processes and facilitating the registration of carbon trading projects under compliance and voluntary mechanisms.<\/p>\n<p>To initiate a carbon trading <a title=\"Invitation for Students to Apply to Project Green Course\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/invitation-for-students-to-apply-to-project-green-course\">project in Tanzania, a Project Proponent must apply<\/a> for approval by submitting an application form and paying the required non-refundable application fees. The <a title=\"ONLINE COURSE: Designing Conservation Projects and Measuring Impact\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/online-course-designing-conservation-projects-and-measuring-impact\">Designated National Authority or National Focal Point reviews the project<\/a> idea within a specified time frame. Once approved, the <a title=\"Call for Concept Notes for Regional Innovation Collaboration Projects in eastern Africa\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/call-for-concept-notes-for-regional-innovation-collaboration-projects-in-eastern-africa\">Project Proponent develops a detailed Project Concept Note<\/a>, which outlines the key elements and objectives of the project.<\/p>\n<p>Upon submission of the Project Concept Note, the Designated National Authority or National Focal Point reviews it and issues a Letter of No Objection if the project meets the necessary criteria. If improvements are needed, the authority provides recommendations to <a title=\"IUCN Launches the Project \u201cEnhancing climate resilience of Biodiversity Hotspots in Jordan\u201d\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/iucn-launches-the-project-enhancing-climate-resilience-of-biodiversity-hotspots-in-jordan\">enhance the Project<\/a> Concept Note.<\/p>\n<p>After obtaining the Letter of No Objection, the <a title=\"Call for Project Grant 2021: Sustainable development and climate change.\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/call-for-project-grant-2021-sustainable-development-and-climate-change\">Project Proponent is required to develop<\/a> a comprehensive Project Document within a specific timeframe. The Designated National Authority or National Focal Point reviews the <a title=\"Call for Project Proposal: Access to Renewable Energy\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/call-for-project-proposal-access-to-renewable-energy\">Project Document to ensure compliance with the regulations and submits the project proposal<\/a> to the Minister responsible for the Environment for Endorsement of Implementation.<\/p>\n<p>Once the Endorsement of Implementation is <a title=\"Research Grants for Field Research 2024\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/research-grants-for-field-research-2024\">granted<\/a>, the Project Proponent has a specified period to commence the implementation of project activities. This timeline emphasizes the importance of prompt <a title=\"Dreaming big on climate action means finding the money to pay for it\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/dreaming-big-on-climate-action-means-finding-the-money-to-pay-for-it\">action to address climate change<\/a> and achieve tangible results.<\/p>\n<p>Costs and benefits sharing arrangements in carbon trading projects in Tanzania consider factors such as the capital invested and the roles and responsibilities of project stakeholders. In land-based projects, the Managing Authority, typically the property owner, is entitled to 61% of the gross revenues generated from the sale of Certified <a title=\"Trends and projections: limited rebound in EU emissions amid post-pandemic recovery and energy crisis\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/trends-and-projections-limited-rebound-in-eu-emissions-amid-post-pandemic-recovery-and-energy-crisis\">Emission<\/a> Reductions. The remaining 39% is allocated, with 9% paid to the Designated National Authority or National Focal Point. However, <a title=\"Vacancy: Research Project Manager\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/vacancy-research-project-manager\">projects with high initial investment costs involve negotiated arrangements between the Managing<\/a> Authority and the Project Proponent.<\/p>\n<p>To ensure fairness and equity in costs and benefits sharing, the Designated National Authority or National Focal Point provides guidance and <a title=\"Facilitating stakeholders to apply multi-sectoral forum for mitigating conflicting interests for sustainable management of mangroves (2013-2015).\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/research\/facilitating-stakeholders-to-apply-multi-sectoral-forum-for-mitigating-conflicting-interests-for-sustainable-management-of-mangroves-2013-2015\">facilitates transparent negotiations among project stakeholders<\/a>.<\/p>\n<p>It is essential to adhere to the regulations governing carbon trading projects in Tanzania. Non-compliance is considered an offense, with penalties including fines ranging from TZS 10,000,000 to TZS 10,000,000,000 (approximately USD 4,000,000) and the possibility of imprisonment for up to 12 years.<\/p>\n<p>By promoting and supporting carbon trading projects, Tanzania aims to make a meaningful contribution to global efforts in reducing greenhouse gas emissions, while simultaneously advancing sustainable development and environmental <a title=\"Science Communication Course\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/science-communication-course\">conservation<\/a> within the country.<\/p>\n<p class=\"kingster-page-title\"><strong>The requirement to register a carbon trading project<br \/>\n<\/strong>Carbon Tanzania projects should meet two (2) requirements in order to operate.<\/p>\n<div id=\"kingster-page-wrapper\" class=\"kingster-page-wrapper\">\n<div class=\"kingster-content-container kingster-container\">\n<div class=\"kingster-content-area kingster-item-pdlr kingster-sidebar-style-none clearfix\">\n<div>\n<p>The requirements are:<\/p>\n<\/div>\n<div>\n<ul>\n<li>A person shall not operate a carbon trading project that has not been registered with the Registrar; and<\/li>\n<li>For the project to be registered with the Registrar, it needs to have the following elements:\n<ul>\n<li>obtain a letter of consent and participation of partners engaged in the project;<\/li>\n<li>have clearance of ownership of the property involved in the project;<\/li>\n<li>involve the <a title=\"Ways forest conservation can benefit local communities and wildlife\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/ways-forest-conservation-can-benefit-local-communities-and-wildlife\">local communities<\/a> in the implementation of the project;<\/li>\n<li>disclose relevant project information including costs incurred, verified <a href=\"https:\/\/www.ncmc.sua.ac.tz\/news\/australia-emissions-reduction-fund\">emission reductions<\/a> and estimated revenues;<\/li>\n<li>indicate expected employment creation to the <a title=\"Call for national experts: strengthening capacity among African forestry stakeholders for implementing REDD+ in Anglophone and Lusophone Africa\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/call-for-national-experts-strengthening-capacity-among-african-forestry-stakeholders-for-implementing-redd-in-anglophone-and-lusophone-africa\">national experts<\/a> and local communities;<\/li>\n<li>indicate commitment to corporate social responsibility;<\/li>\n<li>adhere to national priority carbon trading sectors;<\/li>\n<li>be in line with <a title=\"Call for Proposal: Analytical Study on National Energy Policy and Regulatory Frameworks\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/call-for-proposal-analytical-study-on-national-energy-policy-and-regulatory-frameworks\">national policies<\/a> laws and strategies;<\/li>\n<li>show how the project will <a title=\"The contribution of the forest sector to the national economy\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/the-contribution-of-the-forest-sector-to-the-national-economy\">contribute to the Nationally<\/a> Determined Contributions;<\/li>\n<li>adhere to transparency and fairness in business; and<\/li>\n<li>adhere to national investment priorities, ecological, social, cultural and economic safeguards.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.ncmc.sua.ac.tz\/wp-content\/uploads\/\/2022\/11\/the-Environmental-Management-Control-and-Management-of-Carbon-Trading-Regulations-2022-i.pdf\">Environmental Management (Control and Management of Carbon Trading) Regulations, 2022<\/a><\/p>\n<p><a href=\"https:\/\/www.ncmc.sua.ac.tz\/wp-content\/uploads\/\/2022\/11\/Kanuni-hizi-zitajulikana-Kanuni-za-Udhibiti-na-Usimamizi-wa-Biashara-ya-Kaboni-za-Mwaka-2022.pdf\">Kanuni za Udhibiti na Usimamizi wa Biashara ya Kaboni za Mwaka 2022<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"kingster-page-title\"><strong>Procedures to establish and operate carbon trading projects<\/strong><\/p>\n<div>\n<ol>\n<li>The project proponent or Managing Authority shall apply for approval of the carbon trading project idea to the Designated National Authority or National Focal Point by filling the application form prescribed in the First Schedule;<\/li>\n<li>The completed application form shall be accompanied with proof of payment of a non-refundable application fee of between USD 250 (for citizens) and USD 500 (for non-citizens) as prescribed in the Second Schedule;<\/li>\n<li>The Designated National Authority or National Focal Point shall within thirty (30) days process and respond to the proponent on the registration of the project idea;<\/li>\n<li>Where the requirements for application have been complied with the Designated National Authority or National Focal Point shall direct the proponent or the <a title=\"PhD Research Concept Note: Invasion, impacts and management of Prosopis and Water Hyacinth in Tanzania\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/phd-research-concept-note-invasion-impacts-and-management-of-prosopis-and-water-hyacinth-in-tanzania\">Managing Authority to develop a Project Concept Note<\/a>. The <a title=\"Tech4Nature partners announce project to study impact of tourism on biodiversity in Spain\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/tech4nature-partners-announce-project-to-study-impact-of-tourism-on-biodiversity-in-spain\">project proponent (in collaboration with Managing Authority or project partners<\/a>) shall have ninety (90) days from the date of registration of the project idea to develop a Project Concept Note.<\/li>\n<li>The Project Concept <a title=\"Travel Advisory Note and Registration Guide to New Postgraduate Students\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/travel-advisory-note-and-registration-guide-to-new-postgraduate-students\">Note shall then be submitted to the Designated National Authority or National Focal Point for review and scrutiny accompanied by proof of payment of project registration<\/a> fees (1% of the expected CER from the project) as prescribed in the Second Schedule and consent from the Managing Authority in the form of extract minutes in line with established procedures of the respective authority;<\/li>\n<li>The Designated National Authority or National Focal Point shall within thirty (30) days of receiving the Project Concept Note issue a letter of no objection for a qualified Project Concept Note as prescribed in the Third Schedule or a letter of recommendation for improvement of the Project Concept Note;<\/li>\n<li>The project proponent (in collaboration with Managing Authority or project partners) shall have twelve (12) months to <a title=\"FSP 300 Research Project I: Research Methods and Proposal development\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/study\/fsp-300-research-project-i-research-methods-and-proposal-development\">develop a Project<\/a> Document after obtaining the letter of no objection. The proponent may by way of written notice request for an extension of time by stating the reasons for the delay to <a title=\"Launching of the Development Corridors Partnership (DCP) Project in Tanzania\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/launching-of-the-development-corridors-partnership-dcp-project-in-tanzania\">develop and submit the Project<\/a> Document and an extension time of not more than six (6) months may be given;<\/li>\n<li>The Project Document submitted to the Designated National Authority or National Focal Point must abide by accepted international standards on carbon trading including validation of the project where required;<\/li>\n<li>The Designated National Authority or National Focal Point shall within thirty (30) days from the receipt of the <a title=\"Call for project proposals: Nature Conservation in Africa\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/call-for-project-proposals-nature-conservation-in-africa\">Project Document and upon satisfaction that the Project Document meets all the requirements, submit to the Minister responsible for environment (the <strong>Minister<\/strong>) the project proposal<\/a> for endorsement of implementation (the letter of endorsement shall be prescribed in the Fourth Schedule); and<\/li>\n<li>The proponent shall within two (2) years after receiving the endorsement start implementing the project.<\/li>\n<\/ol>\n<p><strong>Instances where the endorsement may be cancelled<br \/>\n<\/strong>The endorsement for project implementation may be cancelled in the following circumstances:<\/p>\n<ul>\n<li>where the proponent has voluntarily cancelled the project by submitting an official notice;<\/li>\n<li>where the endorsement was obtained through misrepresentation;<\/li>\n<li>where the continued operation of the project activity is likely to be injurious to the environment or human health;<\/li>\n<li>where the project activities are overridden by other public interests;<\/li>\n<li>where there was insufficient or holding of <a title=\"Call for applications for field surveyors for household survey &amp; key informant interview\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/call-for-applications-for-field-surveyors-for-household-survey-key-informant-interview\">information in the application<\/a> process;<\/li>\n<li>failure to submit the Project Concept Note or Project Document within the prescribed time;<\/li>\n<li>failure to commence the project activities within the prescribed time; and<\/li>\n<li>non-compliance with the project requirements as stipulated under the Regulations.<\/li>\n<\/ul>\n<p><strong>Offences and penalties<\/strong><\/p>\n<p>It is an offence to:<\/p>\n<ul>\n<li>provide false, misleading or deceptive information in order to secure an endorsement;<\/li>\n<li>to fail to furnish <a title=\"Global Biodiversity Information Facility (GBIF) invites proposals for project funding\" href=\"https:\/\/www.cfwt.sua.ac.tz\/ecosystems\/news\/global-biodiversity-information-facility-gbif-invites-proposals-for-project-funding\">information related or connected to the project<\/a> as required by the provisions of the Regulations;<\/li>\n<li>violate any conditions attached to the grant of endorsement under the Regulations; and<\/li>\n<li>implement a carbon trading project without endorsement issued under the Regulations.<\/li>\n<\/ul>\n<p>Any person who violates the provisions of the Regulations commits an offence and upon conviction shall be liable to a fine of not less than TZS 10 million (equivalent to USD 4,279) but not exceeding TZS 10 billion (equivalent to USD 4,279,000) or imprisonment for a term not exceeding twelve (12) years or to both fine and imprisonment.
